EU Considers Revising Crypto Regulations in Response to US Stablecoin Legislation

The European Union is on the verge of adjusting the rules regarding crypto assets, particularly now that the United States is implementing its own legislation concerning stablecoins. This is evident from a recent report indicating that EU officials intend to reconsider the proposed changes to the Markets in Crypto-Assets (MiCA). The focus here is on expanding the framework to bring non-EU companies issuing stablecoins under the rules as well.

This revision of the rules, which is expected to take place in 2027, is a direct response to US legislation called the Guiding and Establishing National Innovation for US Stablecoins (GENIUS) Act. EU officials feel the pressure to provide clarity regarding regulations for US stablecoin issuers within member states and are also considering expanding MiCA to include guidelines for tokenized payments and deposits. For investors, this means a potential increase in legal clarity and uniformity in the European market.

Since the entry into force of MiCA, crypto companies offering services to EU-based customers in 27 member states must now be certified as Crypto-Asset Service Providers (CASPs). This licensing requirement came into effect on July 1. Interestingly, before these rules were fully implemented, European Commission officials had already opened a period for comments on possible revisions, during which aspects of decentralized finance (DeFi) and stablecoins were also discussed.

The European Securities and Markets Authority (ESMA), responsible for the supervisory role in the implementation of MiCA, recently announced that it will investigate the operational resilience of CASPs registered under the new regulations. This investigation, which runs from July through the first half of 2027, focuses on how crypto companies manage the operational risks of custodianship. This is of material importance, as the security of user assets remains a key focus for both investors and regulators in the rapidly growing crypto market.

Significant developments are underway, not only in Europe but also in the US, where lawmakers are further shaping their own directives, with the Digital Asset Market Clarity (CLARITY) Act serving as a key example. This legislation, which has been approved by two major committees over the past twelve months, is expected to be put to a vote in the Senate in July, after which the focus on European regulations may intensify even further.
